Our Mediation Process

Intake & Preparation
Fill out the online form, or get in touch with our office by e-mail at info@albertlawco.com with the details of: who the parties to the dispute are (full legal names and any aliases), what the issues in the dispute include (a brief summary), and any lawyers involved. If there are any pressing deadlines or timelines, please also make us aware of those. We will make sure it is a matter that we are able to assist with. We will reach out to confirm all parties are interested in participating and the parties will sign the agreement to mediate.


Pre-Mediation Sessions
We typically conduct pre-mediation intake sessions with each party / their lawyer to better understand the issues and to make sure all parties are ready and able to participate in a mediation.


The Mediation
A mediation can be conducted in many ways, including online or in-person. Typically, we will schedule a full day for a mediation, but we may adjust this schedule depending on the parties and their needs. If we are able to resolve the issues at the mediation, this will be documented in a format agreeable to all parties.


Post-Mediation
Depending on the type of mediation (family vs. civil) and depending on whether they had legal counsel during the mediation, legal advice may be required before the parties sign the documented agreement.

  • No, but you may choose to have one present or available for advice. We often work with parties who each have lawyers, but we are just as happy to work with individuals who do not have lawyers.

  • We don’t focus on a particular area of law. Each of our mediators has specific areas they spend more time mediating. For example, as a certified family mediator, Emily Anderson has more of a focus on family mediations. Whereas with her background in estate litigation, Sara Albert enjoys assisting with estate litigation mediations. Estate disputes in British Columbia frequently involve ongoing relationships and emotionally charged issues. Mediation offers a structured way to resolve these matters while preserving dignity and minimizing long-term conflict.

  • Mediation is a voluntary process. Each party has to agree on the outcome. Then, we can formalize that agreement into binding settlements once terms are finalized.

  • You retain the option to pursue other legal processes. Mediation is confidential, so nothing shared during the mediation can be used outside of the mediation process. However, it is a rare mediation that does not at least advance the parties towards a new understanding of the issues, or a shorter and more concise legal process.

  • Most mediations are completed in a half-day or full-day session, depending on complexity. If it is not completed by the end of the scheduled session, we can schedule additional sessions.

  • Our prices vary depending on the type of mediation and complexity. We can offer flat fees or hourly rates.
